Subject:- Procedure for handling references received from Lokpal of India.
Under the provisions contained in Lokpal and Lokayuktas Act, 2013, Lokpal of India has the mandate to inquire into allegations of corruption against certain public functionaries and for matters connected with them.
2. As per provisions contained under Section 20 (1) (b) of the Lokpal and Lokayuktas Act. 2013. complaints in respect of public servants belonging to Group A. B. C or D are referred by Lokpal to Central Vigilance Commission for preliminary inquiry. The Commission forwards such references to the Chief Vigilance Officers concerned for preliminary inquiry and report.
3. It may be noted that as per provisions contained under Section 20(2) of the Lokpal and Lokayuktas Act. 2013. a report 1s to be submitted within a period of sixty days and for reasons to be recorded in writing. within a further period of sixty days from the date of receipt of the complaint.
4. The Commission has directed that the
Chief Vigilance Officers should ensure that the Investigating officer, who is entrusted with preliminary inquiry of any Lokpal referred complaint, should have an uninterrupted tenure of minimum of 04 months in Vigilance Units/Organization concerned in order to ensure continuity and timely completion of such complaints.
